Matthew R. Malone (Matt.Malone@emwnlaw.com) is a member of Embry Merritt Womack Nance, PLLC, he has represented clients in litigation matters in state and federal courts and before administrative agencies. He has experience in trial and appellate level litigation in a variety of areas, including administrative law (generally public service commission matters), personal injury and wrongful death, federal and state criminal defense and domestic relations.
Matt worked as a member at Hurt, Deckard & May, PLLC for over twenty years before joining Embry Merritt Womack Nance, PLLC in August 2024. Matt is recognized as a Super Lawyer and he is admitted to practice before the Kentucky Supreme Court, the Eastern and Western District of Kentucky, the 6th Circuit Court of Appeals and the US Supreme Court.

- Acting as class counsel in federal and state court in several class action matters including a federal matter which settled in 2023 for $1,500,000.
- Representing a young woman’s estate killed by a reckless painting contractor driving the wrong way on I-75.
- Representing an elderly pedestrian struck by a negligent city worker in a truck which settled for $2,750,000.
- Representing a teacher struck by a commercial vehicle in Central Kentucky in 2024 which settled for $1,100,000.

- Successfully recovered $300,000,000 on behalf of the Commonwealth of Kentucky adverse to PokerStars.
Public Service Commission
- Representing a conglomeration of natural gas marketers in a several day hearing with all of the major Kentucky local distribution companies before the Kentucky Public Service Commission involving retail gas choice programs.
- Representing numerous telecommunication companies before the Kentucky Public Service Commission seeking Eligible Transportation Carrier (ETC) status.
- Representing the Kentucky School Boards Association as an intervener in many different rate increase actions by electric and gas utilities before the Kentucky Public Service Commission.
- Representing numerous natural gas supply companies before the Kentucky Public Service Commission in numerous actions.
- Representing the Kentucky Coal Association in a several day hearing before the Kentucky Public Service Commission where Louisville Gas and Electric Company sought to retire coal plants.
- Representing a natural gas transportation provider before the Kentucky Public Service Commission in gas utility rate increase matters.
- Representing Louisville-Jefferson County Metropolitan Sewer District in a tariff matter adverse to Louisville Gas and Electric Company.
- Representing South Kentucky Rural Electric Company in a purchase power agreement matter before the Kentucky Public Service Commission.
Criminal Defense
- Representing individuals charged with all types of crimes in federal court in the Eastern and Western District of Kentucky in both trial and appellate work.
- Representing an individual in a vote-buying conspiracy trial in federal court in the Eastern District of Kentucky.
- Representing an individual charged with a crime in state court which led to oral arguments before the Kentucky Court of Appeals and the Kentucky Supreme Court.
